LOJIWAY TERMS OF USE – USER AGREEMENT

 

 

I. Definitions and Explanations

• “Lojiway” is Eren ÖZKAN, with the registered address at Ataşehir Merkez PTT Branch, Küçükbakkalköy Mah. Kayışdağı Cad. No:87/A, 34750 Ataşehir/İstanbul, Turkey.

• “Internet Site” is the website owned by Eren ÖZKAN with the domain name “lojiway.com”.

• “Mobile Application” is the application named “Lojiway” on all mobile application download platforms, including but not limited to AppStore and Google Store.

• “Identity Information” includes the User's name, surname, email, date of birth (optional), gender (optional), preferences, settings, and photos (if uploaded).

• “Terms of Use” refers to these Terms of Use for the application and internet site.

• “User” means an individual over the age of 18 who has registered an account on the mobile application and internet site in their own name.

• “Lojiway Activities” are activities that allow users to connect and travel together in their own vehicles.

II. Subject These Terms of Use govern the rules that Users must comply with when using Lojiway and the rights Eren Özkan holds in the event of non-compliance with these rules.

III. General Provisions

• Every User has the right to benefit from the services offered by Lojiway on the mobile application and internet site.

• Every user must be over 18 years of age, and membership cannot be transferred to third parties.

• Each User will be given only one user account registered in their own name.

• Meeting and traveling with others through Lojiway involves inherent risks, including but not limited to bodily injury, harm, or death. Lojiway does not screen users, verify identities, or guarantee safety. Therefore, all risks arising from the use of this application and/or internet site belong to the user.

• Lojiway is a technology platform that enables users to interact; it does not provide transport/transportation services. Therefore, Lojiway is not responsible for the vehicles, driving abilities, or behavior of the users.

• Prohibited Conduct;

  • When using the Application: Do not engage in racing, reckless, or dangerous driving, violate traffic rules, use Lojiway to organize or participate in races, or use the Application or engage in distracting activities while driving. Lojiway does not provide such services, and Lojiway does not support or endorse such actions. Users who engage in such activities/actions assume all responsibility.

  • If Lojiway detects any account violating this rule, it has the right to immediately suspend or close the relevant account.

• Every user is solely responsible for their interactions with other users. In this context, Lojiway accepts no responsibility.

  • Therefore, every user is deemed to have accepted the following terms:

    • Be respectful to all users; do not resort to harassment or violence.

    • Offer rides only when you are legally licensed and, if necessary, insured.

    • Do not use the Application for unlawful purposes.

• Lojiway may offer paid features or subscriptions in the future. You agree to pay all related fees and taxes. Unless otherwise specified, all fees are non-refundable. Lojiway will provide reasonable notice before any price or feature changes.

• To the maximum extent permitted by applicable law, Lojiway and its operator are not responsible for:

  • Bodily injury, property damage, or losses arising from the use of the Application.

  • Incidents involving other users (including rides or meetups).

  • The behavior or content of any user.

• Every user agrees to indemnify, defend, and hold harmless Lojiway and its operator against any claims, damages, liabilities, costs, or expenses arising from their use of the application, their interactions with other users, or their violation of these Terms.

• Every user is deemed to have released Lojiway and its operator from all claims, demands, and damages arising from disputes with other users or participation in rides arranged through the Application.

• Your account may be suspended or deleted by Lojiway at any time for any reason, including but not limited to the violation of any of the above terms or unsafe behavior.

IV. Zero Tolerance Policy Against Offensive Content and Abuse

• Lojiway applies a strict zero-tolerance policy for offensive content and abuse. You may not share, upload, transmit, or display any content that contains or facilitates: harassment or hate speech; threats, intimidation, or incitement to violence; sexual content or abuse; graphic violence/images; illegal or dangerous activity; extremist/terrorist content; unauthorized sharing of personal data (doxxing) or invasion of privacy; impersonation; spam, fraud, or malware; or other content that can be reasonably considered harmful/unsafe.

• Sanctions: Violations may result in content removal, immediate suspension, or permanent account closure without prior notice. Serious violations (e.g., threats, sexual abuse, incitement) will result in a permanent ban and may be reported to law enforcement.

• Reporting: Use the in-app reporting/blocking tools or send an email to support@lojiway.com to report violations.

V. Other Matters

• These Terms of Use may be periodically changed or expanded by Lojiway. The new/updated Terms of Use will become effective on the date they are published on the Internet Site or through the mobile application. Your continued use of Lojiway after the changes constitutes your acceptance of the updated Terms.

• These provisions are subject to and shall be interpreted according to the laws of the Republic of Turkey.

• Users can send an email to support@lojiway.com to get information about access to and use of Lojiway.

• For the resolution of any disputes that may arise regarding the Terms of Use, the Istanbul Anatolian courts and enforcement offices shall have exclusive jurisdiction.

VI. End-User License Agreement (EULA) – Acceptance and License

• These provisions are an integral part of the user agreement and are deemed to be accepted by all users.

• By creating an account, tapping the “I Accept” button, or using the Application, you agree to be bound by this End-User License Agreement—in addition to the Terms above.

• License: You are granted a personal, limited, revocable, non-exclusive, and non-transferable license to install and use the Application only for its intended use.

• Restrictions: You may not copy, modify, reverse engineer, decompile, or sublicense the Application; bypass security/access controls, or use it in a way that could harm our services.
